General terms and conditions
Below you will find the general sales, delivery and payment conditions of Macy Lifestyle, located in Monnickendam, registered with the Amsterdam Chamber of Commerce under number 93011857.
A written copy of the terms and conditions will be sent upon request.
General terms and conditions
- Definitions and applicability
1.1 These general Terms and Conditions of Sale (hereinafter: Terms and Conditions) apply to all offers, orders and agreements of Macy Lifestyle, unless Macy Lifestyle agrees to other terms and conditions in writing. The customer cannot derive any rights for future transactions from any agreed deviations.
1.2 Accepting an offer or placing an order implies that you accept the applicability of these conditions.
1.3 Deviations from the provisions of these terms and conditions may only be made in writing, in which case the other provisions will remain in full force.
- Prices and payments
2.1 The prices stated for the products and services offered are in euros including VAT. Excluding shipping costs.
2.2 For parcel post within the Netherlands we charge €5.95. For orders over €75,- no shipping costs are charged. For customers from countries other than the Netherlands, the contribution to the shipping costs depends on the country of destination and the size of your order, you can request a free quote in advance via info@macylifestyle.nl
PLEASE NOTE: If you are making a transfer from abroad, you must always mention our BIC (SWIFT) and IBAN details. If you do not, your bank will charge transaction costs, which we cannot guarantee. When mentioning the BIC and IBAN details, a transfer from other EU countries is free of charge.
2.3 After placing an order, you will receive a confirmation by e-mail stating the total costs, including shipping costs. Payment is always made in advance by: online via IDEAL, shop pay, or advance payment via bank transfer. In the case of advance payment, payment must be made within 14 days of ordering. The reservation of the ordered items will then expire. Goods remain the property of Macy Lifestyle until payment has been made. No additional costs will be charged for online payments.
2.4 All prices listed on the site www.macylifestyle are in Euro, including VAT, but excluding shipping costs. All prices are subject to price changes. Changed prices do not affect current orders. If the buyer is not located in the country of shipment, the buyer is liable for any VAT or import duties that may be due. Additional shipping costs will also be charged for shipments outside the Netherlands.
2.5 Unfortunately, the ordered items cannot be delivered cash on delivery.
- Delivery
3.1 We ship all orders within 3 working days after receipt of payment to the delivery address specified in the order. If the ordered products are not delivered within a reasonable period and we deviate from this for certain reasons, you will receive a message by e-mail, however, an order will always be sent within 3 working days after receipt of payment. If you are not at home at the time of delivery, you can collect the package at the post office in your area.
3.2 Exceeding the agreed delivery times does not entitle the customer to compensation, termination of the agreement or non-fulfilment of any obligation that may arise for him from this or any other related agreement.
3.3 The product must be delivered to the customer no later than 30 days after ordering and payment. If this does not happen, the customer can immediately cancel the purchase. This does not apply if the parties have agreed on a different delivery period.
3.4 Delivery in parts is permitted.
3.5 We do our best to keep the website as up to date as possible, however it may happen that a product is unexpectedly no longer available. In this case we will contact you as soon as possible.
3.6 Macy Lifestyle uses the services of PostNL for delivery. Macy Lifestyle is not responsible for the way in which such a party handles the goods and how the delivery/delivery takes place. Macy Lifestyle cannot be held liable for the non-delivery and/or loss of the ordered goods. The order is sent at the customer's risk. The packages sent by Macy Lifestyle are provided with a barcode (except for letter post) so that the entire route can be tracked up to the front door of the addressee. In the event of alleged loss of a shipment, PostNL will conduct an investigation. If this investigation shows that a package has been delivered to the specified address, the package will not be considered missing.
3.7 Ownership of the products is transferred upon delivery if the products have been paid for. Macy Lifestyle is entitled to deliver in parts. The additional costs of subsequent delivery are of course borne by Macy Lifestyle.
3.8 You must check the order for any deviations immediately upon delivery.
3.9 If you fail to provide information or instructions necessary for delivery, the products intended for delivery will be stored at your risk and expense.
- Complaints and returns
4.1 We do everything we can to deliver you a perfect product, minor deviations in trade, for example in quality, colour, size or finish must be accepted by you. If the ordered article nevertheless does not meet your expectations, we ask you to send an e-mail to info@macylifestyle.nl within 14 working days after receiving the order. If Macy Lifestyle has not received any written complaints within this period, Macy Lifestyle is deemed to have fully met its obligations with regard to the delivered goods.
4.2 If you have received a damaged product, Macy Lifestyle will exchange it free of charge for exactly the same product, provided it is in stock. To do this, you must contact info@macylifestyle within 14 days. If the article is damaged during transport, the damage will not be covered by Macy Lifestyle.
4.3 If you have received a different product instead of the ordered product, Macy Lifestyle will exchange it free of charge for the product you ordered plus the refund of return costs. To do this, you must contact info@macylifestyle within 14 days. Complaints about an order must always be reported to us in writing/by email within 14 days.
4.5 Macy Lifestyle is not liable for lost returns.
- Offers/agreements
5.1 All offers from Macy Lifestyle are without obligation and Macy Lifestyle expressly reserves the right to change prices, in particular when this is necessary on the basis of (legal) regulations.
5.2 An agreement is only concluded after acceptance of your order by Macy Lifestyle. Macy Lifestyle is entitled to refuse orders or to attach certain conditions to the delivery, unless expressly stated otherwise. If an order is not accepted, Macy Lifestyle will communicate this after receipt of the order.
5.3 All offers made by Macy Lifestyle are without obligation. Offers are subject to the availability of the products. Offers do not automatically apply to repeat orders. Macy Lifestyle has the right to terminate the agreement. We will of course contact you about this. Offers/Sale cannot be returned.
- Liability
6.1 Any liability of Macy Lifestyle and of the staff and products of Macy Lifestyle for all damage, of whatever nature, direct or indirect, including business damage, consequential damage, damage to movable or immovable property or to persons, is expressly excluded. Macy Lifestyle is also not liable for damage caused by third parties during the execution of the agreement.
6.2 Macy Lifestyle accepts no liability for any damage resulting from the use of Macy Lifestyle products.
6.3 Any liability of Macy Lifestyle towards the buyer is in any case limited to a maximum of the invoice amount that the buyer owes to Macy Lifestyle under the relevant agreement.
6.4 Macy Lifestyle is not liable for any misunderstandings, mutilations, delays or improper receipt of orders and communications resulting from the use of the Internet or any other means of communication in the traffic between you and Macy Lifestyle, or between Macy Lifestyle and third parties, insofar as this relates to the relationship between you and Macy Lifestyle, unless and insofar as there is intent or gross negligence on the part of Macy Lifestyle.
6.5 Macy Lifestyle cannot be held responsible for color deviations due to screen quality.
- Compensation
7.1 Macy Lifestyle can only be held liable for damage that can be attributed to its intent or gross negligence, or that has arisen due to circumstances for which it is responsible under mandatory law.
7.2 Circumstances that in any case are not at the risk of Macy Lifestyle are: illness, import and export and/or transit ban, transport problems, non-fulfilment of obligations by suppliers, disruptions in production, etc.
7.3 Macy Lifestyle is never liable for any damages other than property damage.
7.4 The provisions of this article shall not affect Macy Lifestyle's statutory liability under mandatory provisions.
- Force majeur
8.1 The parties shall not be obliged to fulfil any obligation if they are prevented from doing so as a result of a circumstance that is not attributable to fault and for which they are not responsible under the law, a legal act or generally accepted views.
8.2 Force majeure in these general terms and conditions shall be understood to mean, in addition to what is understood in this regard in law and case law, all external causes, foreseen or unforeseen, over which Macy Lifestyle has no influence, but which prevent Macy Lifestyle from fulfilling its obligations.
8.3v Macy Lifestyle has the right to invoke force majeure if the circumstance that prevents (further) fulfillment occurs after Macy Lifestyle should have fulfilled its obligation.
8.4 Parties may suspend their obligations under the agreement for the duration of the force majeure. If this period lasts longer than two months, each party is entitled to terminate the agreement without any obligation to pay damages to the other party. If cc has already partially fulfilled its obligations under the agreement at the time the force majeure occurs or will be able to fulfil them, and the part that has been fulfilled or is yet to be fulfilled has an independent value, Macy Lifestyle is entitled to invoice the part that has already been fulfilled or is yet to be fulfilled separately. The consumer is obliged to pay this invoice as if it were a separate agreement.
- Miscellaneous
9.1 If you provide Macy Lifestyle with an address in writing, Macy Lifestyle is entitled to send all orders to that address, unless you provide Macy Lifestyle with another address in writing to which your orders should be sent.
9.2 If Macy Lifestyle has permitted deviations from these conditions for a short or long period of time, either tacitly or otherwise, this shall not affect its right to subsequently demand immediate and strict compliance with these conditions. You may never assert any right on the grounds that Macy Lifestyle applies these conditions flexibly.
9.3 If one or more of the provisions of these terms and conditions or any other agreement with Macy Lifestyle are in conflict with any applicable legal provision, the provision in question will lapse and will be replaced by a new legally permissible comparable provision to be determined by Macy Lifestyle.
9.4 Macy Lifestyle is authorized to use third parties in the execution of your order(s).
9.5 Macy Lifestyle reserves the right to change these Terms and Conditions.
- Privacy
All personal data will be used exclusively for processing the order and will never be made available to third parties. As well as that they are used as relationship management between the customer and Macy Lifestyle
- Copyright
All rights reserved. No part of this website may be copied, stored and/or distributed without written permission from Macy Lifestyle.
- Disputes and applicable law
12.1 All rights, obligations, offers, orders and agreements to which these terms and conditions apply, as well as these terms and conditions, are exclusively governed by Dutch law.
12.2 All disputes between the parties will be submitted exclusively to the competent court in the Netherlands.
- Final provision
These general terms and conditions aim at a reasonable regulation of the legal relationship between Macy Lifestyle and the consumer. Insofar as circumstances may arise in which these terms and conditions, or any provision thereof, may lead to unreasonable outcomes, these terms and conditions will not apply to that extent.
